These Terms of Use (the "Terms") set out the conditions for using the mobile application "DO & DON'T" (the "App") provided by MODE: ANY ("we"). By installing or using the App you agree to these Terms.

1. Scope

These Terms apply to all matters between you and us regarding the App. Notices and policies we publish in the App or on the web (including the Privacy Policy) form part of these Terms.

2. What the App is

The App is a self-control / lifestyle tool for tracking habits (DO) and abstinence (DON'T). Figures such as records, statistics and conversions ("time reclaimed" and "money saved") are estimates based on values you enter yourself; we do not guarantee their accuracy or usefulness. The App does not provide medical or health diagnosis, treatment or advice.

3. Environment and data

App data is stored on your device. We are not responsible for restoring data lost through device failure, loss, reset, uninstallation, etc. Please use the backup feature to protect your data.
Backup files you export are stored and managed under your own responsibility.
Devices, network access and communication charges needed to use the App are your responsibility.

4. Pro plan

The App offers a paid plan "Pro" with additional features, as a monthly or yearly subscription. Prices and contents are as displayed in the App and in each store (Google Play / App Store).
Purchases and payments are handled by each store's billing system and are subject to the store's terms.
Pro may come with a free trial period. Unless you cancel during the free trial, it converts to a paid subscription and you are charged when the trial ends. Thereafter Pro renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Cancel from your store's subscription management page. Deleting the App does not cancel the subscription.
After cancellation you can keep using Pro until the end of the paid period. No pro-rated refunds are given.
Refunds follow each store's policy; we cannot issue refunds directly.
We may change Pro's contents or price with prior notice. Price changes apply from the next renewal and are communicated according to each store's procedures.

5. Advertising

The App may display third-party ads. Some features (unlocking extra slots, protecting a record, taking a Free Pass early, etc.) are offered in exchange for watching a video ad. We are not responsible for the content of ads or advertisers' services.

6. Prohibited conduct

Acts that violate laws or public order
Reverse engineering, modification, or unauthorized copying/redistribution of the App
Ad-click fraud, faking purchase status, or otherwise interfering with the normal operation of the App or third-party services
Any other act we reasonably deem inappropriate

7. Intellectual property

Intellectual property rights in the App and its design, text and programs belong to us or the rightful owners. Rights in the content and photos you enter into the App remain yours.

8. Changes, suspension and termination

We may change the App or suspend/terminate its provision without prior notice, and are not liable for damage resulting from this. If we discontinue Pro, we will give reasonable advance notice.

9. Disclaimer

We do not warrant that the App is free of defects in fact or law (safety, accuracy, completeness, fitness for a particular purpose, etc.).
Except in cases of our willful misconduct or gross negligence, we are not liable for damage arising from use of or inability to use the App. Where we are liable, our liability is capped at the Pro fees you paid us in the most recent one month.
Where consumer protection law or other mandatory law limits this disclaimer, it applies only to that extent.

10. Changes to these Terms

We may amend these Terms when necessary. Amended Terms take effect when posted on this page, and continued use of the App after posting constitutes acceptance.

11. Governing law and jurisdiction

These Terms are governed by the laws of Japan. Any dispute relating to the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over our location as the court of first instance.
